Terms of Service

1. Acceptance of Terms

By accessing or using the BrighterConnect platform ("Service"), including our website, mobile applications, and related services, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

BrighterConnect is a transportation network company (TNC) operating in the State of Maryland. We connect riders with independent contractor drivers for on-demand transportation services.

3. Eligibility

• You must be at least 18 years old to use the Service.
• You must provide accurate and complete registration information.
• Drivers must pass background checks and maintain required documentation.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities under your account. Notify us immediately of any unauthorized use.

5. Fares and Payment

• Fares are calculated based on distance, time, and applicable fees.
• A booking fee of $2.99 (Standard) or $3.99 (XL) applies per ride.
• A 6% processing fee and $0.50 Maryland regulatory fee apply.
• Payment is processed via Stripe. By using the Service, you authorize charges to your payment method.
• Cancellation fees may apply per our cancellation policy.

6. Cancellation Policy

Riders may cancel a ride at any time. A $5.00 cancellation fee applies if cancelled after a driver has been assigned. No-show fees of $10.00 may apply.

7. Driver Terms

Drivers are independent contractors, not employees of BrighterConnect. Drivers must maintain valid insurance, driver's license, and vehicle registration. Drivers receive 75% of the fare; BrighterConnect retains 25% as a platform fee.

8. Prohibited Conduct

• Harassment, discrimination, or threatening behavior.
• Transporting illegal substances or weapons.
• Fraudulent or deceptive activity.
• Tampering with the platform or its systems.

9. Safety

BrighterConnect prioritizes safety. All drivers undergo background checks via Checkr. Emergency assistance is available through the app's SOS feature. We reserve the right to suspend or terminate accounts that pose safety risks.

10. Limitation of Liability

BrighterConnect is not liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Dispute Resolution

Disputes shall be resolved through binding arbitration in the State of Maryland, except where prohibited by law. You waive the right to participate in class actions.

12. Modifications

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or in-app notification.

13. Governing Law

These Terms are governed by the laws of the State of Maryland, United States.
